An odd situation has arisen where a Judge refuses to appoint some club waterkeepers. They all have been approved by the local regional fisheries board. The club and their solicitors have been before the Judge several times. The Judge says that he dosent personally know the proposed waterkeepers and he wont appoint them.
I have looked at the 1959 Act and it dosent actually state that he has to appoint them.

This section was amended by Section 17 the 1991 Fisheries(Amendment)Act. This Section states that the appointment shall not be confirmed unless the person has a letter of suitability from the local regional fisheries board. I would think that by implication that would be the only grounds on which a Judge could refuse to sign the appointment. The amendment is below

I have no doubt that more legal opinions will be got over the next few days.

Last Wed the Judge continued to say that he wouldnt sign the waterkeepers warrants. The clubs solicitors then asked him for permission to go to a higher court (District) to see would a judge there sign the warrants. The Judge gave permission.
